Buyer
assumes all risks and liabilities (i) arising out of unloading,
discharge, storage, handling and use of the Product, or (ii) arising
out of compliance or non-compliance with federal, state, provincial,
or local laws and regulations governing or controlling such activity.
Seller shall not be subject to any liability or damages
for delay in performance or non-performance as a result of force
majeure, which includes but is not limited to fire, flood, ice, natural
catastrophe, pandemic, strike, lockout, labor shortage, labor dispute
or trouble, accident, riot, act of any governmental authority,
sanctions, act of God, war, act of terrorism (including cyber-
terrorism and ransomware attacks), or other contingencies and/or
circumstances beyond its reasonable control interfering with the
production, supply, transportation, or consumption of the Products
or with the supply of any raw materials used in connection therewith,
or the inability of Seller to purchase raw materials at a commercially
reasonable price, or if performance would be contrary to, or
constitute a violation of, any regulation, law, sanction or requirement
of any recognized governmental authority, and quantities so affected
may be eliminated by Seller from the Contract without liability or
damages to Seller, but the Contract shall otherwise remain
unaffected.

1.0 PRODUCT DESCRIPTION
Thermoplastic material in pellet form.
2.0 TEST METHODS
NEU test methods are modeled after ASTM testing standards, where applicable.
3.0 OPERATIONAL DEFINTIONS
3.1 Lot (Batch): Material manufactured at one time.
3.2 Blend: No more than three lots of a specific raw material, combined together to form a
homogeneous mixture.
3.2.1 Full lot tractability of non-proprietary formulations will be reflected on the COC
3.3 Certification: “Certificate of Conformance” or “Certificate of Analysis” based material
requirements
3.4 Certificate of Analysis: Document containing information that the product conforms to
the established Product Specifications.
3.5 Certificate of Conformance: Document containing confirmation that the product
conforms to the defined formulation.
3.6 Finished Product Form: Finished product shape (Cylindrical, Spherical)
3.7 Product Specification: the product specifications that are contained in a written
document signed by NEU, or if such document does not exist, the Certificate of Analysis
or Certificate of Conformance issued by NEU.

Inspection may include applicable internal systems, calibration programs,
laboratory practices, and equipment pertaining to the Customer-specific product.
6.1.1 Adequate prior notice (30 days) must be given, with a proposed agenda.
6.1.2 The scope of the inspection is at the discretion of NEU.
6.1.3 Non-Disclosure Agreement and\or Visitor Confidentiality Agreement is required of
Customer.
7.0 SUPPLIER CONTROL and REGULATORY RESPONSIBILTY
7.1 The control of suppliers and regulatory responsibility of the vendors and product
supplied by NEU to the Customer are dependent on the specification and ownership of
the components used to manufacture the product, as further outlined below.
7.1.1 Raw materials, components and suppliers developed or specified by NEU are
controlled and monitored by NEU.
7.1.2 Raw materials, components and suppliers developed or specified by Customer
are controlled and monitored by Customer.
7.1.2.1 NEU may survey suppliers specified by Customer on behalf of Customer
to satisfy a Customer request for information.
