The parties agree that Seller need not further object to any specific terms and conditions set by Buyer; such failure to object to Buyer’s specific terms and conditions is not an acceptance of any such terms and conditions. The arbitration shall be conducted in English and in accordance with the rules of the Arbitration Foundation of South Africa. The Arbitrator will make an appropriate cost order in relation to the costs incurred by the parties in respect of the arbitration.
