Kupující je povinen písemně oznámit Prodávajícímu existenci jakéhokoli nároku týkajícího se Výrobku (ať už ze smlouvy, porušení záruky, z nedbalosti, objektivní odpovědnosti, jiného deliktu nebo jinak) do třiceti (30) dnů po obdržení Výrobku, který je předmětem reklamace, nebo do uplynutí příslušné doby spotřeby, je-li stanovena, a to podle toho, co nastane dříve.
Pozastavení a ukončení Pokud (i) Kupující neplní své závazky vůči Prodávajícímu a neposkytne mu odpovídající záruku plnění před datem plánované dodávky; nebo (ii) pokud má Prodávající důvodné pochybnosti o plnění závazků ze strany Kupujícího a Kupující neposkytne Prodávajícímu odpovídající záruku plnění před datem plánované dodávky, a to do třiceti (30) dnů od výzvy Prodávajícího k poskytnutí takové záruky; nebo (iii) pokud se Kupující stane insolventním nebo neschopným splácet své dluhy v době jejich splatnosti, nebo vstoupí do likvidace, nebo bude zahájeno konkurzní řízení ze strany Kupujícího nebo proti němu, nebo pokud bude jmenován správce či nucený správce celého majetku Kupujícího nebo jeho podstatné části, nebo pokud Kupující provede jakýkoli převod ve prospěch svých věřitelů; nebo (iv) v případě, že Kupující nedodrží zákon, vyhlášku, nařízení, předpis nebo normu (dále jen „Zákony a normy“), může Prodávající písemným oznámením Kupujícímu, aniž by byla dotčena jeho jiná práva: (a) požadovat vrácení dodaných Výrobků, které nebyly zaplaceny, přičemž veškeré náklady spojené s vymáháním Výrobků jdou na účet Kupujícího; a/nebo (b) pozastavit své plnění nebo vypovědět potvrzení objednávky na čekající dodávku Výrobků, pokud Kupující neprovede platbu za Výrobky v hotovosti předem nebo neposkytne Prodávajícímu odpovídající záruku takové platby.
Kupující bere na vědomí a prohlašuje, že je seznámen se všemi platnými zákony a předpisy týkajícími se obchodu, vývozu nebo zpětného vývozu výrobků, služeb, dat nebo technologií (dále jen „Zboží“), včetně, mimo jiné, předpisů o mezinárodním obchodu se zbraněmi (ITAR), předpisů o správě vývozu (EAR), předpisů o obchodních sankcích spravovaných Úřadem pro kontrolu zahraničních aktiv Ministerstva financí USA, zákona č. 38/1994 Sb., o mezinárodním obchodu s vojenským materiálem, zákon č. 594/2004 Sb. o provádění režimu ES pro kontrolu vývozu, přepravy, zprostředkování a tranzitu zboží dvojího užití, zákon č. 69/2006 Sb. o provádění mezinárodních sankcí, zákon č. 1/2023 Sb. o sankcích, jakož i všechny přímo použitelné právní předpisy EU (dále jen „Zákony o kontrole obchodu“).
