In no event shall Seller be liable for any damages and/or costs due to delay in delivery. Except to the extent solely attributable to the gross negligence or willful misconduct of Seller, Buyer will indemnify, defend and hold Seller harmless from all costs, expenses, damages, judgments or other loss, including without limitation costs of investigation, litigation and reasonable attorney’s fees (“Buyer Indemnity Costs”), arising out of Buyer’s selection, use, sale or further processing of the Product or Buyer’s product made therefrom. Buyer shall indemnify, defend and save Seller harmless against any and all liability for Buyer Indemnity Costs arising out of or in any way connected with Buyer’s failure to disseminate such information.

These projects come with many challenges, including difficulties in installation and minimizing levelized cost of energy (LCOE). These systems utilize small handling equipment and connectors, enabling ease of installation and low maintenance costs. The actual revenue and cost savings impact more than doubled our expectations.

We have decided to hold the Annual Meeting virtually again this year because doing so enables greater shareholder attendance and participation from any location around the world, and reduces the cost and environmental impact of the Annual Meeting. By 2030, to ensure alignment with Avientʼs expectations on environmental, social and governance requirements, Avient will assess its top suppliers representing 90% of our total raw material costs. Further, we did not utilize any statistical sampling or cost-of-living adjustments for purposes of determining our median employee.
